Before beginning your shopping experience, we invite you to carefully read our General Terms and Conditions of Sale (GTC) to understand the terms and conditions that govern your purchases on our website.
1. The Seller
NAFA atelier, a single-member simplified joint-stock company with capital of 1,000 euros, registered in the Béziers trade and companies register under number 979 461 290, VAT, whose registered office is located at 4 Rue André Chassefières, 34300, Agde, VAT identification number FR 33979461290, email address contact@nafa-atelier.fr, telephone 0779037103.
NAFA atelier is an official online store for products imported from Brazil and sold in France.
These general terms and conditions of sale (hereinafter the “General Terms and Conditions of Sale”) apply without restriction or reservation to all sales of NAFA atelier products offered on the Online Store (hereinafter the “Products”) by the Seller.
2. The Client
The General Conditions of Sale apply to orders for Products placed on the NAFA Atelier Online Store by natural persons of legal age who have the capacity to enter into a contract and meet the definition of consumer, within the meaning of the Consumer Code.
The Customer acknowledges having read the General Conditions of Sale at the time of placing the order and at the latest at the time of validation of the order.

4. Scope of these General Conditions of Sale
The General Conditions of Sale are supplemented by the Privacy Policy and the Cookies Policy of the Nafa Atelier Online Store.
No divergent, contradictory or complementary T&Cs are applicable.
The General Terms and Conditions of Sale are subject to modification at any time by the Seller. The applicable version is the one in effect at the time the Customer confirms the order, which is constituted by the Customer's payment of the order.
5. Product Information
The Products offered by the Seller are those appearing on the NAFA Atelier Online Store.
When browsing the NAFA Atelier Online Store, the Customer can access the description of each Product (including the name of the Product, its reference, its price, its color, its composition and, where applicable, the special collection to which it belongs). The main characteristics of the Products added to the basket are also listed on the "Your basket" page.
6. Exclusivity of Our Products
At NAFA Atelier, we believe in the importance of exclusivity for our customers. We are proud to offer you unique and quality products from Brazil, but due to our limited stock, we want to ensure our customers have the opportunity to enjoy these rare treasures.
Here's how we ensure the exclusivity of our products :

7. Order process and conclusion of the NAFA workshop sales contract
Ordering process
To select the Products they wish to purchase, the Customer must click on the "Add to Cart" button on the Product page. By clicking on "View Cart," the Customer can check the contents of their cart, as well as the prices and characteristics of the Products added. They can then finalize their order by clicking on "Finalize my order."
Conclusion of the sales contract
To finalize his order, the Customer must, after having checked the content and price of the Products:
– Accept the General Conditions of Sale as well as the Confidentiality Policy of the NAFA atelier Online Store, this acceptance being essential for the conclusion of the sales contract;
– Choose the delivery methods for your order, after having read the delivery times and prices for each of the delivery methods offered, indicated on the page;
– Select the chosen payment method.
The Customer must then click on the "Finalize my order" button. By clicking on this button, the Customer agrees to be bound to the Seller by a sales contract and agrees to pay the amount of the order placed on the NAFA atelier Online Store.
Any validation of the order by the Customer constitutes express acceptance of the General Conditions of Sale by the Customer without any restriction or reservation.
Order confirmation
The Seller will confirm by email, to the address provided by the Customer when ordering and as soon as possible, the correct receipt of the order placed by the Customer. The confirmation email includes a summary of the order placed by the Customer as well as a reminder of the General Terms and Conditions of Sale applicable to the sales contract.
Modification and cancellation of the order
Once the Customer has validated the order, he can no longer cancel or modify the order.
8. Payment
Product Prices : The prices displayed on our website are expressed by default in euros, all French taxes included (TTC), in accordance with the French value-added tax (VAT) of 20%. These prices exclude delivery costs. NAFA ATELIER reserves the right to modify prices at any time, without notice. Ownership of the products remains with NAFA ATELIER until full payment is received.
The “Payment” step allows you to choose the desired payment method; the amount indicated at this step is the total amount of the order including shipping costs.
Total Amount Due : The total amount you must pay will be specified when confirming your order. The total price, including shipping costs, will be clearly indicated in the “Shipping Address” step of the order process. The product price does not cover any shipping costs, which will be presented to the customer during the order validation process, before the customer confirms their order.
Payment Methods : The “Payment” step allows you to choose your preferred payment method. The amount shown at this step corresponds to the total of your order, including shipping costs.
Billing : Once we have received confirmation of your order, a detailed invoice will be made available to you in the “My Account” section of our website. This invoice will summarize the products ordered, the total price paid and debited, as well as the transaction details.
9. Payment Methods and Transaction Security
Accepted Payment Methods : All items purchased on our website, www.nafa-atelier.fr , can be paid for by credit card or via PayPal.
Payment by Credit Card : When you choose to pay by credit card, the debit is made at the time of order validation, after confirmation from the card-issuing bank. To ensure the security of your data, in accordance with the CNIL recommendations, credit card payments are processed via highly secure pages. These pages allow you to securely enter your card information, such as the card number, expiration date, and visual cryptogram (in accordance with the PCI DSS standard).
Payment Data Security : Once you enter this information, our platform encrypts it to ensure its complete confidentiality. This encrypted payment data is then transmitted to the relevant bank, away from prying eyes. At no time is your banking information accessible to NAFA ATELIER's computer system.
Payment Refusal : If your card-issuing bank declines the transaction, your order will be automatically canceled. We would like to emphasize that our priority is to ensure the security and confidentiality of your financial information at every stage of the purchasing process.
10. Obligation to pay for the order
The Customer is informed and acknowledges that by placing an order on the NAFA Atelier Online Store, he undertakes to pay the Seller the full amount of the order at the time of validation of the order and declares that he has the capacity and means necessary to honor it.
11. Retention of title
The Products ordered by the Customer remain the property of the Seller until full payment of the amount of the order for the Products (delivery costs included).
12. Delivery and Shipping
Delivery Address : NAFA ATELIER will ship your ordered products to the delivery address you specified in the “Delivery Address” step of your order. It is essential that you carefully check the accuracy of this address. Any reshipping costs due to an inaccurate address will be your responsibility.
Delivery Costs : Delivery costs are calculated based on the delivery method you chose when ordering, at the “Delivery Method” step.
Order Processing : NAFA ATELIER is committed to processing each order within 1 to 2 business days. However, please note that these times may be slightly longer during busy periods. You will receive an email confirming the shipment of your order, along with a tracking number. This tracking number will allow you to locate your package and track its progress on the carrier's website.
Indicative Delivery Times : In mainland France, delivery times should generally not exceed 15 days from receipt of the order confirmation email. Standard delivery times generally vary from 1 to 5 working days. However, please note that NAFA ATELIER cannot be held responsible for any delays attributable to the carrier.
For international deliveries, delivery times should generally not exceed 15 days from receipt of the order confirmation email. Standard delivery times are approximately 3 to 8 business days for Europe and 5 to 14 business days for the rest of the world. However, please note that NAFA ATELIER cannot be held responsible for any delays attributable to the carrier.
13. Delay in delivery
In the event of a delay in the delivery of the order compared to the time indicated by the Seller, the Customer may formally order the Seller to make the delivery within a reasonable additional time in accordance with the following terms:

In the event of non-delivery within the expected reasonable additional period, the Customer has the option of cancelling the order with the Seller and terminating the sales contract under the same terms, namely:

Termination of the Contract : The contract will be considered terminated on the date on which the Seller receives written notification informing it of the termination. However, if delivery has already taken place in the meantime, the contract will not be terminated.
Essential Delivery Conditions : When the delivery time is essential for the Customer under the sales contract, the Customer has the right to immediately terminate the sales contract in accordance with the terms previously mentioned, without having to demand a reasonable additional delivery time from the Seller. The decisive nature of the delivery time may arise from the circumstances that expressly surrounded the conclusion of the contract. If delivery occurs in the meantime, the order must be returned in full to the Seller, and the Customer will be reimbursed for the amount of the order as well as the return costs, in accordance with the reimbursement terms set out in these General Terms and Conditions of Sale.
14. Delivery Difficulties
Address Errors or Unable to Deliver : In the event of an error in the delivery address provided by the Customer or if, for any reason, delivery is not possible, the package will be returned to the Seller, and the order will be canceled. The Customer will receive a refund of the order amount, excluding delivery charges, which will remain the property of the Seller.
Unforeseeable Events : The Seller shall not be liable for any delay or non-performance resulting from external events unforeseeable at the time of the order. Such events may include, but are not limited to, situations such as war, acts of terrorism, strikes, national or local states of emergency, disruptions in transportation services, power or utility outages, pandemics, earthquakes, or other natural disasters. In such cases, the Seller shall not be liable, and no refund shall be given to the Customer. Payments made shall remain the property of the Seller.
15. Loyalty Program
Loyalty Program Membership : To benefit from the NAFA ATELIER Loyalty Program, members must register, i.e., create a customer account. Membership in the Loyalty Program is completely free.
Loyalty Point Acquisition : Every purchase made in-store and online generates loyalty points at a ratio of 1 euro equals 1 point. However, please note that purchases of services such as shipping, cord replacements, after-sales service fees, etc., as well as purchases made with a credit note, do not qualify for loyalty points.
Validity of Loyalty Points : Loyalty points are credited to your account 24 to 48 hours after each purchase and are valid for 1 year.
Loyalty Gift Voucher : Each time the member reaches a total of 200 loyalty points from in-store and/or online purchases, a 20% “loyalty gift voucher” is issued and sent by email. The member must have agreed to receive communications/newsletters by email to be eligible for this reward. This 20% “loyalty gift voucher” is valid for 3 months and can be used for an online purchase. It cannot be split, and no change, credit note, or gift card will be issued. Please note that this voucher cannot be used for a purchase under €30.
Viewing Loyalty Points : All loyalty points are available in the “Loyalty Program” section of your customer account. If you have not received your 20% loyalty gift voucher, you can contact our Customer Service for assistance.
16. Compliance of the Order, Reservations and Transfer of Risks
In the event of a discrepancy between the Products received by the Customer and those ordered, or in the event of receipt of an incomplete or damaged order during transport, it is the Customer's responsibility to issue reservations and contact our Customer Service to report any problem within 48 hours of receipt of the Products. If the Customer does not issue reservations within this 48-hour period, the delivery will be considered compliant.
Transfer of Risks : The risks of loss and damage to the Products ordered are transferred to the Customer at the time when the Customer, or a third party designated by the Customer, other than the carrier, takes physical possession of the order.
17. Customs Fees and Legal Disputes
Customs Fees : When you place an order on our site and the delivery is made outside of Metropolitan France, taxes and customs duties may be applied when the package reaches its destination. These customs duties and taxes, if applicable, are your responsibility. NAFA ATELIER is not obliged to verify or inform you of applicable customs duties and taxes. It is your responsibility to check with the competent authorities in your country for details.
Language of the General Conditions of Sale : The main language of these general conditions of sale is French. This contract is governed by French law.
Dispute Resolution : In the event of a dispute, the French courts will have sole jurisdiction to rule.
18. Right of Withdrawal
The right of withdrawal cannot be exercised:
- on earrings (pendant earrings, hoop earrings and stud earrings) as well as sets including earrings, for hygiene reasons;
At the Customer's choice, the right of withdrawal can be exercised remotely with Customer Service, according to the methods respectively described below.
Right of withdrawal from Customer Service
The Customer has a period of 30 days from the date of receipt of the Product (by him or by any third party designated by him other than the carrier) to inform the Seller of his wish to exercise his right of withdrawal , without having to justify a reason.
If it is an order for several Products delivered separately or if it is an order for a Product composed of several batches or multiple parts whose delivery is staggered over a defined period, the period starts from the receipt of the last good or batch or the last part.
Terms and conditions for exercising the right of withdrawal with Customer Service
To exercise his right of withdrawal, the Customer must:
- within 30 days of receipt of the Product, inform the Seller of their decision to withdraw by sending an email to the Seller at the following address: contact@nafa-atelier.fr , making a declaration expressing their wish to withdraw and indicating their surname, first name, address and order number, as well as the references of the returned Products;
- at the latest within 14 days following notification of the decision to withdraw, return the Products concerned, in perfect condition and in their original packaging. Failing this, the Seller reserves the right to refuse the return of the Products.
- Affix the prepaid Colissimo label (received with your package) to the return package and seal it securely. The label must be clearly visible on the package, and the return address and barcodes must not be covered or altered.
- Drop off the return package at the Colissimo collection point and keep proof of deposit. The list of collection points can be viewed via this link: https://www.laposte.fr/particulier/outils/trouver-un-point-de-retrait-ou-de-depot-colissimo?sso=true The cost of returning the Products by Colissimo is covered by the Seller, subject to compliance with the return procedure. Failing this, the Seller reserves the right to invoice any costs incurred to organize the return of the Products.
If the customer wishes to return multiple Products from the same order, the customer must return them together in order to benefit from the Seller covering the return costs. Otherwise, only the costs of the first Colissimo return will be covered by the seller and the customer will have to bear the costs of returning the other Products.
The Customer will be informed by email to the address provided when ordering that the Seller has received the returned Products.

19. RETURNED PRODUCTS
You must make your return request directly from the “My Account” area.
After agreement between the two parties, you will be invited to return the product(s), at your expense (unless the product is not compliant or has a manufacturing defect), to Nafa Atelier, at the following address: Nafa Atelier – 4 Rue André Chassefières, 34300 Agde.
You must ensure you have a tracking number and proof of shipment for your products.
If you decide to return multiple items from the same order, it is imperative that all products are returned together.
All returned products must be in their original packaging and undamaged. If the returned product is damaged, it will be returned to you at your expense. If you request a full refund for your order, you must include the entire package received, including the product(s), packaging, and any free gifts offered if there is a special gift offer. In the event of an incomplete return, NAFA Atelier will not be able to refund your order.
Subject to NAFA Atelier's agreement, you may choose between an exchange or a refund; the exchange may be for the same or a different product. If there is a price difference between the two products, you will either pay the difference, or NAFA Atelier will issue a credit note for the difference.
You will be refunded the amount of the order for the returned product, no later than 14 days after exercising the right of withdrawal.
The refund will be made by bank transfer to the card used to pay the initial invoice.
If you exchange your item, you will receive a credit code by email that can be used on the website. The credit is divisible and valid for 6 months.
20. NAFA Guarantee and Legal Guarantees
The Customer has the following legal guarantees for any Product purchased from the NAFA Atelier Online Store:
- The guarantee of conformity, provided for in Articles L. 217-4 to L. 217-13 of the Consumer Code;
- The guarantee relating to hidden defects in the thing sold, provided for in articles 1641 to 1649 of the Civil Code.
In order to facilitate the implementation of these guarantees, the Customer must keep the confirmation of the order for the Product and/or the invoice for the Product.
Any defect, breakage, or deterioration of the Product resulting from improper use of the Products by the Customer shall not give rise to the activation of any of the legal or commercial guarantees. In this regard, it is recalled that:
- Oxidation is a natural phenomenon, accelerated by contact between the metal and agents such as perfume, sea air, sulfur, skin creams, hairspray, chlorine, and skin acidity. Product use should be adjusted accordingly. It is also recommended not to wear NAFA products while bathing, exercising, or sleeping.
Warranty Duration : NAFA ATELIER offers a 1-year commercial warranty applicable to all our jewelry. This warranty covers manufacturing defects for a period of 1 year from the date of purchase. To benefit from this warranty, the products must be used in accordance with their normal use and you will need to provide proof of purchase, such as a receipt, order reference, or customer account.
Warranty Application Conditions : The warranty applies under normal conditions of use and excludes defects resulting from accidents, mishandling, abusive use (such as shocks, marks of blows, crushing, exposure to corrosive agents), theft, loss, as well as the effects of normal wear and ageing of jewelry.
Repair or Replacement : Any defective parts due to a manufacturing defect duly noted by our Customer Service will be repaired or replaced.
Warranty Claim Process : To claim under the warranty, you must have the purchase invoice for the jewelry, available in your customer account. If you encounter a problem during the warranty period, please contact our customer service by email at the following address: contact@nafa-atelier.fr or by phone at +33 (0) 7 79 03 71 03.
Returning Products Under Warranty : When returning a product under warranty, be sure to protect it carefully and place it in its original packaging. Send the product to NAFA ATELIER, 4 Rue André Chassefières, 34300 Agde, along with the invoice.
21. Refund Policy
Refund of Returned Products : The refund of the price of the returned Products, as well as the corresponding delivery costs (within the limit of standard delivery), will be made in accordance with the payment method chosen when ordering. This means that the refund will be credited to the Visa or Mastercard bank card used for the order or to the Customer's PayPal account.
Refund Period : The refund will be processed as soon as possible after receipt of the returned Products by the Seller. The Customer will receive an email confirming receipt of the returned Products. Please note that only new, unworn Products in perfect condition can be exchanged.
22. Product Exchange Policy
Exchanges Currently Unavailable : At this time, due to technical constraints, exchanges to our warehouse are not available. We will not be able to process exchange requests. We encourage you to return the item and place a new order for the desired product.
23. Applicable law
Sales concluded with NAFA Atelier E-commerce via the website www.nafa-atelier.fr are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing this, all disputes to which this contract may give rise, concerning its validity, interpretation, execution, termination, their consequences, and their aftermath, will be submitted to the competent court in accordance with the rules of jurisdiction of common law.
24. Intellectual Property
The company Nafa Atelier E-commerce is the owner of the website www.nafa-atelier.fr
Furthermore, the graphics, texts, and more generally everything that makes up the website www.nafa-atelier.fr are the property of the company NAFA Atelier or its suppliers. All other graphics appearing on the jewelry and the website www.nafa-atelier.fr belong to the company NAFA Atelier and may not be reproduced. Photos and diagrams representing the products may not be reproduced. All names, logos, brands, and titles used on this site are registered trademarks or names registered by their owners. It is also recalled that all drawings, models, and plans belong to the company NAFA Atelier, which benefits from artistic property rights over all of its products.
You declare that you acknowledge that any counterfeiting of the brand, photos, products, designs or models or other graphics may be punished by criminal and/or civil convictions at the discretion of the company.
25. Personal data
As part of processing your order and customer relations, the Seller is required to collect and process the personal data of the Customer as well as that of the recipient of the order if different.
The Seller respects the confidentiality of this data and undertakes to comply with the Data Protection Act of 6 January 1978 when processing it.
The Customer is informed that his data may be used by the Seller or a third party designated by him to ensure the processing of his order, to inform him of new products and promotional offers, competitions, etc.
In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, oppose, rectify, and delete your personal data. To exercise this right, please contact Customer Service using the contact details provided below.

26. PROVISIONS RELATING TO LEGAL GUARANTEES
Article L211-4 of the Consumer Code
The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity that exists at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility under the contract or has been carried out under his responsibility.
Article L211-5 of the Consumer Code
To comply with the contract, the property must:
– be suitable for the use usually expected of a similar good and, where applicable:
– correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model
– present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling
– or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L211-12 of the Consumer Code
The action resulting from the lack of conformity is prescribed after two years from the delivery of the goods.
Article L211-16 of the Consumer Code
When the buyer requests from the seller, during the course of the commercial guarantee granted to him at the time of the acquisition or repair of a movable good, a repair covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee which remained to run. This period runs from the request for intervention by the buyer or from the provision for repair of the good in question, if this provision is subsequent to the request for intervention.
Article 1641 of the Civil Code
The seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.
